Court grants Obiano’s passport release amid N4bn theft trial
Former Anambra State Governor, Willie Obiano, faced a setback on Thursday as the Federal High Court in Abuja dismissed his attempt to challenge the N4bn theft charges brought against him by the Economic and Financial Crimes Commission (EFCC). Despite this, the court granted Obiano’s request for the release of his passport to undergo a medical trip.
Justice Inyang Ekwo ruled that the EFCC has the jurisdiction to prosecute Obiano, rejecting the ex-governor’s argument that the charges were an abuse of court process. The trial is scheduled to commence on June 27, with Obiano required to return his passport upon his return from the medical trip.
Obiano, arraigned on January 24, faces nine counts related to the alleged misappropriation of Anambra State security votes amounting to N4bn. His lawyer had argued that the EFCC lacked the authority to try him, but the court ruled otherwise, citing the jurisdiction of the Federal High Court in such cases.
The judge dismissed Obiano’s objection, stating that the EFCC Act remains valid unless declared unconstitutional. Furthermore, he emphasized that the Federal High Court operates under summary jurisdiction in criminal proceedings, thereby exempting the requirement for proof of evidence prior to trial.
Following the ruling, Obiano’s legal team requested a variation of his bail conditions due to health concerns. The court granted this request, allowing Obiano to fulfill his medical appointments. However, there were reservations expressed about the duration of his treatment.
While the trial dates were set for June 24-27, the judge granted Obiano’s prayer to return his passport upon his return.
